WE ARE PREPARING FOR A NEW PROCEDURE FOR ASSIGNING BENEFITS FOR TEMPORARY DISABILITY AND PREGNANCY AND CHILDBIRTH FROM 07/01/2024.

  In accordance with Resolution of the Council of Ministers of the Republic of Belarus dated December 12, 2023 No. 877 “On amendments to the resolutions of the Council of Ministers of the Republic of Belarus,” the deadline for implementing the new procedure for assigning benefits for temporary disability and pregnancy and childbirth (hereinafter referred to as benefits) was postponed from 01.01.2024 to 01.07. 2024.

The new procedure for assigning benefits will include cases of temporary disability and pregnancy and childbirth occurring from 07/01/2024 and later.

The main innovations are that the calculation of average daily earnings and the duration of the period for paying mandatory insurance contributions will be made centrally by the bodies of the Social Protection Fund (hereinafter referred to as the Fund) and provided to the accounting service of the payer of mandatory insurance contributions (hereinafter referred to as the payer) upon its request through the corporate portal of the Fund .

The procedure for the Fund to provide information to the payer is spelled out in detail in the Regulations on the procedure for providing information and information when assigning benefits for temporary disability and pregnancy and childbirth, approved by Resolution of the Fund’s Board of August 18, 1023 No. 10 (hereinafter referred to as Regulation No. 10). By Resolution of the Fund's Board of December 29, 2023 No. 19, adjustments were made to Regulation No. 10.

The payer must formulate and send the request to the territorial body of the Fund no later than two working days from the date the insured person applies for benefits.

The request is submitted through the information resource “Personal Account of the Contribution Payer”, located on the corporate portal of the Fund or through a program interface (API) in the “system-to-system” mode.

The request form submitted by the payer has two types: original and cancel.

The order of their presentation has been clarified. So, if an error was made in the previously sent request form (with the exception of the details “Last name”, “Own name” and “Middle name (if any)”), then the request must be submitted with the form type canceling; in other cases, the form type must be filled in original.

 If there is no main place of work or if the recipient of the benefit is on parental leave until he reaches the age of 3 years at the main place on the date of the occurrence of a case of temporary disability, pregnancy and childbirth, a request is filled out for each certificate of incapacity for work of the insured person working part-time. . Moreover, if there are several places of work for internal and (or) external part-time work, the benefit is assigned to one of them (at the choice of the benefit recipient) taking into account earnings from all places of work.

Before submitting a request for an insured person working under an employment contract, the payer must submit form PU-2 within 2 working days from the date the insured person presented a certificate of incapacity for work if information about the part-time work code was not provided after July 1, 2019.

For persons performing work under civil contracts, temporary disability and maternity benefits will be assigned for each place of work.

The amount of average daily earnings for calculating employee benefits is determined by the territorial body of the Fund on the basis of information from individual (personalized) registration in the state social insurance system based on earnings for 18 calendar months (547 calendar days) preceding the quarter in which the right to benefits arose, including during work under employment contracts with other payers (hereinafter referred to as the billing period).

Upon receipt of a request, the territorial body of the Fund, no later than the day following the day of receipt of the request, sends through the information resource “Personal Account of the Contribution Payer” information about the need to submit form PU-3 to payers:

- for whom the insured person worked during the billing period and there is no PU-3 data for the corresponding period on the personal account;

- for insured persons dismissed before 10/01/2023, and for whom the start date of a case of temporary disability, pregnancy and childbirth falls on the second half of 2024. In this case, it is necessary to submit Form PU-3 for 2023, provided that within 9 months 2023, for such an insured person, there were cases of all-day (whole-shift) downtime through no fault of the employee, leave without pay or with partial pay, provided at the initiative of the employer, payments in respect of which, based on the results of inspections and other control measures, deliberate non-accruals were revealed and failure to pay mandatory insurance contributions to the fund budget, or deductions from payments accrued to a person sentenced to correctional labor, in the amount established by a court verdict.

 The amount of the benefit will depend on the duration of the period of payment of compulsory insurance contributions, which is calculated on the basis of individual (personalized) registration data in the state social insurance system, starting from January 1, 2003 until the quarter of the beginning of the case of temporary disability, pregnancy and childbirth.

Regulation No. 10 determines which periods are not included. Previously, these included periods of temporary disability, pregnancy and childbirth. It is now stipulated that the period of payment of compulsory insurance contributions does not include periods of non-payment of compulsory insurance contributions, including unpaid leave, absenteeism without good reason, etc. (except for periods of temporary disability, pregnancy and childbirth, an additional day off from work in month to the mother (stepmother) or father (stepfather), guardian (trustee) raising (raising) a disabled child under the age of eighteen, with payment in the amount of average daily earnings from state social insurance funds.

 The territorial body of the Fund will send notifications through the information resource “Personal Account of the Contribution Payer” to:

- to the payer who made the request:

on changes in the amount of average daily earnings in the event of changes in information about its calculation. Such information will be provided within 6 months from the day following the end of the period of temporary disability, pregnancy and childbirth, but no later than the date of dismissal from work (end of the period of the civil contract);

on non-acceptance of the amount of temporary disability benefits for credit in the event of failure to submit form PU-3 with the appropriate reflection of the period of temporary disability by at least one payer;

- to other payers - about the discrepancy between the periods specified by them in the PU-3 form and the periods in the PU-3 form submitted by the payer who received the information (correction period - 3 business days).

The payer’s obligation to monitor notifications through the information resource “Personal Account of the Contribution Payer” is established.

The form of information that is generated and provided by the territorial body of the Fund at the request of the payer is supplemented with the position “Return”. This position will be filled, for example, in the absence of the right to benefits, when the period for assigning benefits has expired, or the applicant is not the employer of the insured person, or there is no remuneration amount to calculate benefits, etc.
